Election Day Holiday Does
Not Apply To Municipalities

On October 16, 2020, a Sangamon County Judge ruled in favor of the Illinois Municipal League (IML), concluding that Public Act 101-0642, which amends the Election Code, does not apply to municipalities. In other words, municipalities need not close on November 3, 2020, Election Day, unless they so choose. Congratulations to IML for its success on behalf of Illinois municipalities. The Attorney General has the discretion to appeal the court’s decision. We will keep you apprised of the status of the outcome of any such appeal.
